The Delhi High Court recently made a significant decision, granting a man a divorce because of the cruelty he endured from his wife. This cruelty stemmed from her loyalty to her parents over their marriage, causing significant distress to her husband.
Justice Suresh Kumar Kait led the decision, highlighting how the wife’s family intruded into their married life, causing harm to the husband. This overturned a previous ruling from a family court that denied the husband’s plea for divorce despite the couple living separately for about 13 years. During this time, the husband faced a lack of marital intimacy and numerous complaints filed against him, which the court deemed as cruel acts.
The recent verdict from the High Court, with Justice Neena Bansal Krishna on the bench, stated that the husband successfully proved he suffered cruelty and was entitled to divorce. The court pointed out that the wife’s actions, influenced by her parents, prevented her from fostering a meaningful relationship with her husband, neglecting her marital duties and causing mental anguish to her spouse.
The court warned against continuing a “dead relationship,” as it would only lead to more suffering. False complaints lodged against the husband and his family were condemned as mental cruelty, highlighting the importance of seeking legal recourse responsibly.
The court stressed that cohabitation and intimacy are vital for a marriage, and depriving a spouse of these elements makes the marriage unsustainable and extremely cruel.
In this case, the evidence presented left no room for reconciliation between the couple, given the prolonged separation, false accusations, police involvement, and legal battles, all constituting mental cruelty.
Ultimately, the ruling highlights the significance of mutual respect, understanding, and cooperation in maintaining a healthy marital bond while recognizing individuals’ rights to seek legal remedies for genuine grievances.
